1. Introduction

By opting in to receive SMS/text messages from Mark-Taylor Residential ("Company," "we," "us," or "our"), you agree to receive recurring text messages at the mobile number you provide. Messages may include leasing updates, tour confirmations, application or account notifications, resident communications, reminders, maintenance notifications, service-related communications, and, where permitted and where appropriate consent has been obtained, marketing or promotional messages.

Participation in our SMS messaging program is subject to these SMS Terms and Conditions ("Terms") and our Privacy Policy. These Terms are intended to comply with the Telephone Consumer Protection Act (TCPA), FCC rules and guidance, and applicable mobile carrier requirements.

2. SMS Messaging Terms and Conditions

Program Name: SMS Notifications

Program Description: SMS Notifications may include transactional and informational messages related to leasing inquiries, tour scheduling, application updates, account notifications, resident care, maintenance notifications, renewals, service-related communications, and other non-marketing operational messages. Where permitted and where appropriate consent has been obtained, messages may also include marketing or promotional communications.

By opting in to receive SMS messages from Mark-Taylor Residential, you agree to receive recurring automated text messages at the mobile number you provide. Message frequency may vary depending on your interactions with us and the nature of the communication. Message and data rates may apply.

For support, reply HELP to any message or contact us using the information provided below. You may opt out at any time by replying STOP to any message. After opting out, you will no longer receive SMS messages from us unless you re-enroll or unless otherwise permitted by law.

Mobile information, mobile phone numbers, and SMS message consent will not be sold, rented, shared, or disclosed to third parties or affiliates for their own marketing or promotional purposes.

Carriers are not liable for delayed or undelivered messages.

3. Opt-In Consent

By providing your mobile phone number and opting in through one of the approved methods below, you provide prior express consent to receive SMS/text messages from Mark-Taylor Residential.

SMS Confirmation: By replying YES or a similar affirmative response to an SMS opt-in confirmation message sent by us.

Verbal Consent: By providing verbal consent during a recorded phone call in which the SMS consent disclosure is read to you in full.

Written or Paper Forms: By signing or acknowledging a written consent form containing SMS disclosure language identical to that used online.

Message frequency will vary based on your interactions with us and the nature of the communication but will not exceed reasonable limits consistent with the purpose of the communication.

6. Opt-Out Instructions

  • Replying STOP to any text message, or
  • Contacting us using the information listed in Section 11.

After opting out, you will no longer receive SMS messages from us unless you re-enroll or unless otherwise permitted by law, such as for legally required notices.

8. Message and Data Rates

Message and data rates may apply depending on your mobile carrier and plan. Mark-Taylor Residential is not responsible for any charges incurred from SMS messages. You should contact your mobile carrier for details regarding your messaging plan and applicable fees.

9. Do Not Call / Do Not Text Compliance

We comply with all applicable federal and state Do Not Call and Do Not Text regulations. Opt-out requests are honored promptly and maintained on internal suppression lists.

If your number is registered on the National Do Not Call Registry, we will not send promotional SMS messages unless you have provided appropriate consent.

10. Privacy and Data Use

Your personal information is handled in accordance with our Privacy Policy, which explains:

  • What information we collect;
  • How it is used;
  • How it is shared with service providers;
  • How we protect your information; and
  • Your rights regarding your data.

We do not sell, rent, share, or disclose mobile phone numbers, mobile information, SMS opt-in data, or SMS/message consent records with third parties or affiliates for their own marketing or promotional purposes.

Text messaging originator opt-in data and consent are excluded from any data sharing for marketing or promotional purposes and will not be shared with any third parties or affiliates for those purposes.

We may share information with trusted third-party service providers, such as SMS platforms, telecommunications carriers, CRM systems, and analytics providers, solely for the purpose of delivering, supporting, maintaining, and improving our SMS messaging services. These providers are required to protect your information and may not use it for their own marketing or promotional purposes.

11. Service Availability and Disclaimer

SMS delivery is subject to availability and carrier limitations. Mark-Taylor Residential does not guarantee message delivery and is not responsible for delays or failures caused by mobile carriers or third-party service providers.

Carriers are not liable for delayed or undelivered messages.

Messages are provided on an "as-is" and "as-available" basis.

These Terms are governed by the laws of the state in which the applicable Mark-Taylor Residential community is located, without regard to conflict-of-law principles.
